Detenção por tempo indeterminado

The US Senate voted Thursday night to approve a military funding bill that codifies into law the criminal state practices begun under Bush—and continued under Obama—in the name of the “global war on terror.”It explicitly authorizes the military’s indefinite detention without trial of American citizens and mandates that all non-citizens charged as terrorists—including those arrested on US soil—be detained indefinitely by the military rather than brought to trial in a civilian court. 

S.1867 includes these provisions highlighted by the ACLU:If enacted, sections 1031 and 1032 of the NDAA would:

1) Explicitly authorize the federal government to indefinitely imprison without charge or trial American citizens and others picked up inside and outside theUnited States;

2) Mandate military detention of some civilians who would otherwise be outside of military control, including civilians picked up within the United States itself; and

3) Transfer to the Department of Defense core prosecutorial, investigative, law enforcement, penal, and custodial authority and responsibility now held by the Department of Justice.

Não devia surpreender que nos Estados Unidos o cidadão perca oficialmente o direito à defesa e assistência judicial, sendo que na Europa também já andamos a arrastar o cadáver de uma democracia que já nem representativa é, mas surpreende.

A mim e ao Sr.Agamben é que não apanham nos EUA, muito embora as razões dele sejam muito mais interessantes e fundamentadas do que as minhas, claro!
